FAQS
Frequently Asked Questions
How long will the process take?
Time scales can vary greatly depending in the size of the estate in question. This, in combination with a backlog of cases and claims with various third parties, can mean that the process will take up to 6-8 months. However, this is just a guide line and cannot be entirely established until the size of the estate is taken into account.
How can TrustDocs help you with probate proceedings?
Our team will guide you on the process and outline the necessary information; including gathering the necessary information on the client and the notification of their passing, the application for the Grant of Probate, dealing with government bodies such as the HMRC and HMLR and distributing the deceased’s estate to their chosen Beneficiaries.
What exactly is a Grant of Probate?
If the deceased leaves a Will, this process would outline what should happen to their estate. The executors would need to apply for a Grant of Probate which would give them the legal right to administrator the estate in alliance with the clients wishes; e.g. being able to sell a property left by the deceased. If there is no Will left or the document is in some way invalid, then an administrator would then be in charge of distributing the estate, this is normally the next of kin. They would apply for what is known as a ‘Grant of Representation’, otherwise known as ‘Letters of Administration’. This serves the same purpose as a Grant of Probate.
